Wolcott Storm Shelters is an authorized dealer and installer of Survive-A-Storm storm shelters, serving customers throughout Tennessee. We are not the manufacturer of the storm shelters but provide sales, delivery, and installation services for Survive-A-Storm products.

3.2 Service Areas

Our services are primarily available throughout Tennessee. Service to areas outside Tennessee may be available upon request and subject to additional terms and fees.

4. Quotes and Pricing

4.1 Quote Validity

All quotes provided are estimates based on standard installation conditions and are valid for 30 days unless otherwise specified. Final pricing may vary based on actual site conditions, permit requirements, and additional services needed.

4.2 Pricing Changes

We reserve the right to modify pricing due to changes in material costs, manufacturer pricing, or other factors beyond our control. Any price changes will be communicated before final contract execution.

5. Orders and Contracts

5.1 Order Acceptance

All orders are subject to our acceptance. We reserve the right to refuse or cancel orders at our discretion.

5.2 Contract Terms

Detailed terms for specific installations will be provided in separate installation contracts. These Terms of Service supplement but do not replace specific contract terms.

5.3 Changes and Cancellations

Changes to orders may result in additional costs and timeline adjustments. Cancellation policies will be specified in individual contracts.

6. Payment Terms

6.1 Payment Methods

We accept various payment methods including cash, check, credit cards, and financing through approved partners.

6.2 Financing

Third-party financing is available through our partners. Financing terms are subject to credit approval and are governed by separate agreements between you and the financing provider.

6.3 Payment Schedule

Payment schedules will be specified in individual contracts and may include deposits, progress payments, and final payment upon completion.

7. Installation and Delivery

7.1 Site Requirements

Customers are responsible for ensuring adequate site access and meeting preparation requirements as specified in installation contracts.

7.2 Permits and Approvals

While we assist with permit applications, customers are ultimately responsible for obtaining all required permits and approvals. Installation cannot proceed without proper permits.

7.3 Timeline Estimates

Installation timelines are estimates and may be affected by weather, permit delays, site conditions, or other factors beyond our control.

7.4 Site Conditions

Additional costs may apply if site conditions differ from initial assessments or require special equipment or procedures.

8. Warranties

8.1 Product Warranties

Storm shelters are covered by manufacturer warranties provided by Survive-A-Storm. We are not responsible for product warranty claims, which must be directed to the manufacturer.

8.2 Installation Warranty

We provide warranties on our installation workmanship as specified in individual contracts.

8.3 Warranty Limitations

Warranties do not cover damage due to misuse, negligence, normal wear and tear, acts of nature, or modifications not performed by us.

9. Limitation of Liability

9.1 Service Limitations

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY FOR ANY CLAIMS RELATED TO OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE CUSTOMER FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM.

9.2 Consequential Damages

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE.

9.3 Product Performance

While our storm shelters are designed and tested to meet FEMA standards, we cannot guarantee protection in all storm conditions or circumstances.

10. Indemnification

You agree to indemnify and hold harmless Wolcott Storm Shelters, its employees, and agents from any claims, damages, or expenses arising from your use of our services or products, except to the extent caused by our gross negligence or willful misconduct.
